Mutual Recognition of Licensing

The Mutual Recognition legislation enacted by the Commonwealth and each State / Territory Parliament in 1992 and 1993 entitles people who are licensed in any other State or Territory to also be registered in an equivalent category in Tasmania.

The procedure is that the person who is licensed in the other state or territory may lodge a written notice with this Board seeking to be registered in connection with the equivalent occupation in accordance with the Mutual Recognition principle
.

The notice must:-

(a) State that the person is licensed in the occupation in the first State and specify that State;

(b) State the occupation in which licensing is sought and that it is being sought in accordance with the Mutual Recognition principle;

(c) Specify all the States in which the person has substantive licensing in the equivalent occupation;

(d) State that the person is not the subject of disciplinary proceedings in any State (including any preliminary investigations or action that might lead to disciplinary proceedings) in relation to those occupations;

(e) State that the person's licensing in any State is not cancelled or currently suspended as a result of disciplinary action;

(f) State that the person is not otherwise personally prohibited from carrying on any such occupation in any State and is not subject to any special limitations, or restrictions or conditions in carrying on that occupation, as a result of criminal or civil or disciplinary proceedings in any State; and

(g) Give consent to the making of inquiries of and the exchange of information with the authority of any State regarding the person's activities in the relevant occupation or otherwise regarding matters relevant to the notice.

The notice must be accompanied by a document that is either the original or a copy of the instrument evidencing the person's existing licence. The person must certify in the notice that the accompanying document is the original or a complete and accurate copy of the original.

The statement and other information in the notice must be verified by statutory declaration.

The Board regards the following licensed or registered occupations in the AUSTRALIAN CAPITAL TERRITORY as being "equivalent" to the occupations for which registrations are granted in Tasmania:-

The following occupation in the Australian Capital Territory is not regarded by the Board as being "equivalent", so conditions will be attached which restrict the holder to real estate practice in respect of the sale, lease and management of business as defined under S.3 of the Property Agents and Land Transactions Act 2005:-

  Business agent Real estate agent - conditional restricted to business selling activities.
3.
The following occupations in the Australian Capital Territory are NOT regarded by the Board as being "equivalent" to an occupation for which a registrered is granted in Tasmania:-

  Stock and station agent N/A
  Registered stock and station agent N/A
 
However, each application will be considered on its merits and, depending on other licences/registrations held and/or the applicant's experience, if possible either a conditional registration restricted to stock and station activities, or an unconditional registration, may be granted.

The following occupation for which a licence is issued in Tasmania does not have an "equivalent" occupation in The Australian Capital Territory:

The Board regards the following licensed or registered occupations in NEW SOUTH WALES as being "equivalent" to the occupations for which registrations are granted in Tasmania:-

3.
The following occupations in the New South Wales are NOT regarded by the Board as being "equivalent" to an occupation for which a registration is granted in Tasmania:-
